A)General Terms

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Greece. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to SPECNET. Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.

Content Liability

We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. B)Become a Vendor

Only aduts on the Spectrum are eligible to sell their products via SPECNET Maretplace.

How to apply

You can become a Vendor either by becoming a Member (Membership application) or by submitting the Vendor application.

Fees & Commissions

SPECNET does not charge registration fees. The commission for each product sold is 8% before taxes.

The commission is deducted automatically after the sale.

Products

Vendors are not allowed to sell edible nor used products.

You may list up to 30 products from your Store Manager. Please allow 48 hours for approval after submitting a new product.

Pricing & Shipping

Each Vendor is responsible for their product prices. Vendors reserve the right to increase or decrease the prices, as well as create offers and/or coupons. Additionally, the Vendors are responsible for packaging and shipping. You may choose to ship to specific countries, or worldwide.

Responsibility

SPECNET is not responsible for any dispute between Vendor and Customer. The Vendor is responsible for the product’s condition, return, and shipping policies.

Vendor Rejection

Vendors are expected to:

• provide accurate information about their products
• update their Store’s stock
• ship their orders on time
• follow the website’s policies
• respect other vendors

SPECNET has the right to deactive the Vendor’s account or reject an application if one or more of the above terms are not met.

Store Deletion

Vendors have the right to delete their store any time.

False Information

SPECNET Marketplace is designed for and is available to ASD adults only. By submitting an application to become a Vendor, you:

1. acknowledge that you are on the Spectrum
2. agree to participate in brief assesment
3. acknowledge that in case of false information, SPECNET has the right to:

• terminate any partnership and/or account
• request for refund

C)Memberships

Any person who eishes to contribute to SPECNET’s Cause can become a Member.

Free Membership

By applying for a Free Membership, you apply to join SPECNET Community. Anyone can become a Member, but only ASD adults can become Vendors.

Yearly Subscriptions

Anyone who wishes to support our Cause and help us achieve our Goals can apply for a paid membership. with each subscription, SPECNET sends a thank you gift.

Withdrawal

Withdrawals and/or refunds are not possible after the Membrship transaction is complete.

Membership Cancellation

You may cancel your Membership anytime.

D)Events

SPECNET Events are:

• Conferences
• Workshops
• Seminars
• Webinars
• Education & Training courses

Who can participate

Abyone can participate in SPECNET’s Conferences. However  Workshops, Seminars and Webinars are mainly addressed to ASD adults, their families and ASD experts. Our Education & Training courses are available only to ASD adults.

Definitions

Capitalised terms used in these Event Terms have the following meanings:

1. Applicant: each natural or legal person who has submitted an Application Form to be a Participant in an Event, regardless of whether this application has been accepted by SPECNET.
2. Application Fee: the amount of the down payment owed by the Applicant to SPECNET at the time of the conclusion of the Participation Agreement for his application to take part in an Event.
3. Application Form: the online or other form by which a potential Participant applies to take part in an Event.
4. Conditions of Participation: the conditions contained in the Participation Agreement, the Specific Event Terms (if applicable), these Standard Event Terms and the Rules & Regulations together.
5. Controller: according to GDPR.
6. Convention Centre/Hall/Venue: the Convention Centre/Hall/Venue that will host the event.
7. Data subject: according to GDPR.
8. Event: the event to be put on by or in cooperation with SPECNET, whether or not in a Convention Centre/Hall/Venue.
9. Exhibitor Portal: SPECNET’s online portal containing the main information about the Event for the Participants.
10. GDPR: General Data Protection Regulation.
11. Participant: every natural or legal person who has submitted an Application Form to be a Participant in an Event and with whom SPECNET has entered into a Participation Agreement. The Participation Agreement shall enter into force once the Participant has received a confirmation from SPECNET by email.
12. Participation Agreement: the agreement between the Participant and SPECNET on the basis of which the Participant is entitled to take part as such in the Event.
13. Participation Costs: the total costs payable by the Participant to SPECNET and comprising the Application Fee, Stand Hire and, if applicable, Stand Build-up charge.
14. Parties: SPECNET and the Participant.
15. Personal data: according to GDPR.
16. Privacy Legislation: European and national regulations governing the protection of Personal Data, including the GDPR.
17. Processing / Processor: according to GDPR.
18. Rules & Regulations: the SPECNET Rules & Regulations which contain the rules applicable to all visitors to the Convention Centre/Hall/Venue, including exhibitors and hirers, and can be found at https://specnet.org .
19. Specific Event Terms: the Specific Terms applicable to an Event.
20. Standard Event Terms: these Standard Terms and Conditions for Event Participation issued by SPECNET which are applicable to Applicants and Participants.
21. Stand Build-up: the construction and fitting out of the Stand Space, including the provision of gas, water, water drainage, power supply, telephone and other data communication connections at the Stand Space.
22. Stand Build-up Rules: any written Stand Build-up Rules applicable to an Event.
23. Stand Hire: the costs of hiring such number of square metres of floor area as determined by SPECNET for a Stand Space and any costs of the Stand Space.
24. Stand Space: the stand and accompanying square metres hired by a Participant at an Event.

Terms written in the singular include the plural and vice versa, insofar as the text requires.

Application

An application to participate in an Event should be made by completing the Application Form, which can be obtained directly from SPECNET in hard copy or through SPECNET’s online application module. The completed and duly signed Application Form must be submitted to SPECNET. If the Application Form is completed and signed by someone other than a legal representative of the Applicant, the correct name and contact details of a legal representative of the Applicant must be filled in on the Application Form.

The Applicant warrants that the data supplied with his application are correct and that the legal representative listed on the Application Form is duly authorised to represent him.

SPECNET will enter the data obtained from Applicants in a database kept by it for this purpose. Applicant agrees with the Privacy Statement of SPECNET.

Applications which cannot be accepted immediately owing to lack of space may be put on a waiting list. A decision on these applications shall be made before the opening of the relevant Event. Stand Space that falls free as a result of cancellation will be allocated in the same manner.

SPECNET reserves the right to refuse an application at its own discretion. SPECNET also reserves the right, as regards acceptance of applications, to grant priority to members of the associations or organisations acting as joint organisers.

If SPECNET refuses an application, it will refund any payments (including down payments) and will refrain from collecting the Application Fee.

The Participation Agreement is concluded solely by acceptance by SPECNET of the application, whereupon the Applicant becomes a Participant. Acceptance shall be confirmed by SPECNET to the Participant by email.

The Participant shall have the right to cancel the Participation Agreement, free of charge, until payment of the Application Fee is due as set out in the relevant invoice, usually 21 days (the Cancellation Term). The Participation Agreement may be cancelled during the Cancellation Term by sending an email to SPECNET at the email address specified in the Specific Event Terms. After the Cancellation Term, the Participation Agreement may only be terminated subject to payment the cancellation fee set out in the article “Cancellation and stand reduction” below.

After the allocation of the Stand Space, the Participant shall receive his user name and password. This will enables the Participant to visit the Exhibitor Portal, on which all important information can be found concerned the Event, including the Standard Event Terms, Specific Event Terms, the Stand Build-up Rules and the Rules & Regulations.

When allocating the Stand Space, SPECNET will specify the location, type and dimensions of the Stand Space allocated to and hired by the Participant. In allocating the Stand Space, SPECNET will take as much account as possible of the preferences of the Participant. The allocation of the Stand Space is binding on the Participant as regards both its dimensions and its location in the Convention Centre.

Cancellation and stand reduction

Requests by a Participant to cancel or change a Participation Agreement (i.e. to reduce the number of square metres of Stand Space) may be submitted in writing or by email. SPECNET may grant such a request on condition that the Applicant in any event pays the subsequent cancellation fee, which is based on a fixed percentage of the Participation Costs:

• upon cancellation more than 365 days before the first Event build-up day: 15% of the Participation Costs;
• upon cancellation in the period from 365 to 183 days before the first build-up day of the Event: 50% of the Participation Costs;
• upon cancellation in the period from 182 to 63 days before the first build-up day of the Event: 75% of the Participation Costs;
• upon cancellation in the period from 62 to 32 days before the first build-up day of the Event: 100% of the Participation Costs;
• upon cancellation in the period up to and including 31 days before the first build-up day of the Event: 120% of the Participation Costs;
• or such higher amount as is due in the SPECNET’s opinion as compensation for the costs incurred or yet to be incurred as a result of the cancellation or amendment. In the event of cancellation or change, the Participant will always owe the Application Fee to SPECNET.

The VAT owed on the fees referred to in this article will also be charged.

Changes

In extenuating circumstances, SPECNET has the right to amend the dates and times of an Event as stated in the Specific Conditions, the Stand Space, stand type and/or stand location allocated to the Participant or, in exceptional circumstances, to change the concept of the Event or to cancel the Event. In such case, the Participant shall not be entitled to claim compensation for any costs and/or loss or damage incurred.

Changes to dates, times, Stand Space, stand type and/or stand location or to the concept of the Event do not entitle the Participant to cancel his application in whole or in part.

If the Event is canceled, the Participation Agreement will lapse. In such a case, SPECNET will refund all payments made by the Participant to SPECNET, with the exception of the Application Fee and after deducting the costs already incurred by SPECNET in respect of the Event. Such costs will be wholly or partly apportioned among the Participants on a pro-rata basis according to the Stand Space allocated to them. This refund will be made within 60 days after the date on which SPECNET has publicized the cancellation of the Event.

Admission prices and admission tickets

SPECNET may fix an admission price for the Event which applies to all visitors.

Upon payment of their Application Fee, Participants will receive a number of admission tickets, specified in advance, which shall provide continuous admission to the Event. These admission tickets are personal and may not be sold on or used by persons other than the Participant.

Participants may purchase extra admission tickets at a reduced rate from the SPECNET webshop.

Event programme and participants

The Specific Event Terms shall describe the goods and services which will be exhibited at the Event.

SPECNET has the right to refuse goods and services or immediately remove goods and services – or arrange for their removal – from the Event without owing any compensation for such removal and without having to give reasons, even if the goods and services in question are as stated on the Application Form and/or in the Specific Event Terms. Any costs incurred in connection with such removal will be borne by the Participant. For marketing purposes, SPECNET can take photographs and/or make film recordings of the Event and the Stand Spaces and persons present there. SPECNET will ask consent for this purpose if needed. Participants and staff engaged by them must permit publication and/or distribution of the photographs and recordings and indemnify SPECNET against any claims in this respect.

Participants are not permitted to let children under the age of 18 work at the Event, or to bring them to the Event.

Removal of links from our website

Payment obligations

The Participant owes the Participation Costs specified in the Specific Event Terms and any other amounts specified in the Specific Event Terms. All amounts owed will be increased by the VAT due on them.

The Participation Costs, with the exception of the Application Fee which will be charged shortly after the receipt of the Application Form, will be invoiced in two installments prior to the Event. The first installment will be 25% of the Participation Costs and will be charged after the Participation Agreement has become effective, but not earlier than one year before the start of the Event. The second installment will be 75% of the Participation Costs and will be charged, in principle, three months before the start of the Event, unless provided otherwise in the Specific Event Terms. If the Participant considers that he does not owe all or part of an invoice, he should inform SPECNET in writing or by email, giving reasons, within ten days of the date of the invoice, failing which any right to a reduction of the invoice amount will lapse.

SPECNET is entitled to set off payments made by a Participant, first of all against any outstanding debts owed to SPECNET.

Risk and liability

Goods of a Participant, including their packaging, present in the Convention Centre are at the expense and risk of the Participant. SPECNET does not concern itself with the security or insurance of the goods.

The Participant is responsible for obtaining the requisite licences and permits for his participation in the Event and for Event-related activities as well as for complying with the laws and regulations applicable to his activities. SPECNET is not liable for any loss or damage suffered directly or indirectly by a Participant, by his personnel, by persons working on the instructions of the Participant, by the holders of admission tickets issued to the Participant or by his visitors, unless in case of gross negligence of wilful intent on the part of SPECNET.

The Participant is liable for and must take out adequate insurance against any and all loss or damage of any nature whatever that is caused by acts or omissions of the Participant himself, his personnel, persons who work for him or on his instructions in any way whatever, and holders of admission tickets issued to the Participant, and for loss or damage which is caused in any way by his goods and services.  The Participant indemnifies SPECNET against any and all claims that third parties may bring against SPECNET in connection with its acts or omissions.

SPECNET shall not be obliged to intervene in any disputes to which it is not party, with the exception of article 11.2, including but not limited to disputes between Participants and disputes between Participants and visitors.  Any liability of SPECNET is limited to the amount paid out under the terms of SPECNET’s liability insurance, provided always that, in the absence of cover, SPECNET’s liability is limited to the Participation Costs owed by the Participant on the basis of his application.

Non-performance

Where a Participant, his personnel, persons working for or on the instructions of the Participant and holders of admission tickets issued to the Participant act in breach of any provision of the Conditions of Participation or fail to follow an instruction given by or on behalf of SPECNET, SPECNET is entitled, without recourse to the courts and, where necessary, at the expense of the Participant, to take whatever measures it sees fit, including but not limited to the following:

terminate all or part of the Participation Agreement, without the need for prior notice of default; and/or
cancel the admission tickets issued to the Participant and bar the person(s) concerned from the Event and/or the Convention Centre with immediate effect; and/or
cancel or discontinue the build-up of the Stand Space, close or vacate all or part of the Stand Space (or arrange for this to be done), and dispose of the Stand Space thus released or left unoccupied; and/or
keep possession of, store and, if necessary, destroy the goods of the Participant and anything constructed or installed by the Participant; and/or
exclude the Participant concerned from participating in the Event and any other Events to be organised; and/or
if the Participant fails to pay the Participation Costs on time or in full, charge the statutory commercial interest and extrajudicial costs of collection on the amount of the claim(s);

notwithstanding SPECNET’s right to claim full compensation for any loss or damage suffered and/or yet to be suffered.

D)Sponsored Services

By “Sponsored Services” we refer to SPECNET’s sponsored Education & Training Programs, Sponsored Therapy Sessions, as well as Sponsored Website Construction.

Who is eligible

Only ASD Adults are eligible to SPECNET’s Sposored Services.

Availability

The availability of SPECNET’s Sponsored Services depend our the donations we receive. We cannot guarantee nor forsee the number of people who will be able to receive SPECNET’s Sponsoshisps.

False Information

Any idnividual who is not on the Spectrum is not eligible for SPECNET’s Sponsored Services.

To ensure we help as many ASD adults as possible, by applying to receive SPECNET’s Sponsorship, you agree to participate in a brief assessment. In case the applicant disagrees, SPECNET has the right to remove the applicant’s request for SPECNET’s Sponsored Services.

E)Donations

We will use your donation at our discretion but within our stated charitable objectives.

All payments through the Website are to be made by payment card.

Once you confirm to us through the Website that you wish to proceed with your donation your transaction will be processed through our payment services provider, PayPal. By confirming that you wish to proceed with your donation you authorise Sagepay to request funds from your credit or debit card provider.

Donation aid

We will use your donation at our discretion but within our stated charitable objectives. All payments through the Website are to be made by payment card or via PayPal.

Once you confirm to us through the Website that you wish to proceed with your donation your transaction will be processed through our payment services provider, WooCommerce. By confirming that you wish to proceed with your donation you authorize WooCommerce to request funds from your credit, debit, or PayPal card provider.

Unauthorised card use

If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.

Your Information

Before we can process a donation you must provide us with (i) your name, address and email address; and (ii) details of the credit or debit card that you wish to use to fund the donation. We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information.

When you submit your payment details, these details will be transferred to our payment provider, WooCommerce, and your payment data will be collected and processed securely by them. You should make sure that you are aware of WooCommerce’s terms and conditions, which are different from our own, to ensure that you are comfortable with how they will process your personal data before you make a donation.

We won’t share your personal details with any other third party other than is set out in our Privacy Policy. Our Privacy Policy forms part of these Donation Payment Terms and Conditions and by agreeing to these Terms and Conditions you are also agreeing to the way we use and protect your personal information in line with our Privacy Policy.

Refund

If you make an error in your donation please contact us either by email at refund@specnet.org. Please allow us 14 days to make a full refund to you.

General

We reserve the right to amend these Donation Payment Terms and Conditions at any time.
These Donation Payment Terms and Conditions are governed by European law and are subject to the exclusive jurisdiction of the Greek courts.
